1. About These Terms

These terms apply to your use of the website oe.co.ke (the "Site") and to any purchase you make from Oman Electronics ("we", "our" or "us"), whether online or in our store at Rehema House, Ground Floor, Standard Street, Nairobi CBD, Kenya. By using the Site or placing an order, you agree to these terms. If you do not agree, please do not use the Site or place an order.

These terms should be read together with our Privacy Policy, Shipping & Delivery Policy and Return and Refund Policy.

2. Using the Site

• You must be at least 18 years old, or have the permission of a parent or guardian, to place an order.
• You must give accurate and complete information when you order or contact us.
• You must not use the Site for anything unlawful, attempt to interfere with its operation or security, or use it to send us fraudulent orders.
• You are responsible for keeping any account details you create confidential.

3. Products and Product Information

We try to describe our products, specifications, images and prices accurately. Specifications are supplied by manufacturers and may change. Product images are for illustration, and the item you receive may differ slightly in packaging or minor details. If you need to confirm a detail before buying, contact us.

All products are subject to availability. If an item you ordered is not available, we will tell you and offer a suitable alternative or a full refund.

4. Prices and Payment

• Prices are shown in Kenya Shillings (KES).
• Delivery charges, where they apply, are set out in our Shipping & Delivery Policy and shown at checkout.
• The payment methods available for your order are shown at checkout. You can also pay in store.
• Prices and promotions can change without notice, but a change does not affect an order we have already accepted.
• Where a product page shows a reduced price next to a higher price, the reduced price is the price you pay.

If we discover a clear pricing error after you order, we will contact you before processing it. You can then choose to confirm the order at the correct price or cancel it for a full refund.

5. Placing and Accepting Orders

When you place an order, you are making an offer to buy. We accept your order when we confirm it to you or dispatch the goods. We may decline or cancel an order, for example if an item is unavailable, we cannot deliver to your address, we cannot verify your details, or we suspect fraud. If we cancel an order after you have paid, we will refund you in full.

6. Delivery

We deliver within Kenya. Delivery times are estimates and depend on your location and the delivery method you choose, as explained in our Shipping & Delivery Policy. Risk in the goods passes to you when they are delivered to you or collected by you. Ownership passes to you when we have received full payment.

Please check your order on delivery and report any damage, defect or incorrect item within 48 hours.

7. Returns, Refunds and Exchanges

Returns, refunds and exchanges are governed by our Return and Refund Policy, which forms part of these terms.

8. Warranty

The warranty that applies to a product is stated on its product page and, where relevant, in the manufacturer's documentation that comes with the product. Warranty length and cover depend on the product and brand. Keep your receipt and any warranty papers, as you may need them to make a claim. To make a warranty claim, contact us with your order number and a description of the problem.

Warranties do not usually cover damage caused by misuse, accidents, liquid damage, unauthorised repairs or normal wear and tear. Please check the manufacturer's warranty terms for details.

9. Your Legal Rights

Nothing in these terms limits or excludes any right you have under Kenyan consumer protection law, including your right to receive goods that match their description and are of acceptable quality.

10. Our Liability

Subject to section 9, we are not liable for loss or damage that was not reasonably foreseeable when you placed your order, for loss of profit or business, or for delays or failures caused by events outside our reasonable control, such as strikes, severe weather, power or network failures, or actions of public authorities. Our liability for any product is limited to the price you paid for it, except where the law does not allow such a limit. Nothing in these terms excludes liability for death or personal injury caused by our negligence, or for fraud.

11. Intellectual Property

The content of the Site, including text, logos, images and design, belongs to Oman Electronics or its licensors, or is used with permission. Brand names and logos of the products we sell belong to their owners. You may view and print pages for your own personal use, but you may not copy, reproduce or use Site content for commercial purposes without our written permission.

12. Links to Other Websites

The Site may link to websites run by others. We do not control those sites and are not responsible for their content or privacy practices.

13. Privacy

We handle your personal information as described in our Privacy Policy.

14. Changes to These Terms

We may update these terms from time to time. The "Last updated" date at the top of this page shows when they were most recently changed. The terms in force when you place an order are the ones that apply to that order.

15. Governing Law and Disputes

These terms are governed by the laws of Kenya. If you have a complaint, please contact us first so we can try to resolve it. If we cannot resolve it, the courts of Kenya have jurisdiction, without affecting any right you may have to bring a complaint to a consumer protection authority.
